A New York woman could be facing up to a year in jail for violating a restraining order through Facebook tagging, a judge ruled recently.
Maria Gonzalez broke her restraining order with a former sister-in-law by tagging her in two separate comments on Facebook.
The restraining order had prohibited Gonzalez from making contact in person, by phone, or electronically, but because the comments included tagging, which sent a notification to the former family member, they qualify as a communication.
Judge Susan Capeci cited a recent ruling from a state high court option that compared Facebook messages to emails, and denied Gonzalez’s move to dismiss the charge.
